1. Definitions
"Service" means all digital services, platforms, and content provided by Cardiac Purr via cardiac-purr.com and any associated platforms.
"User" means any natural or legal person accessing or using our Service.
"Digital Services Act" or "DSA" refers to Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services.
"Cardiac Purr" means 2info spółka z ograniczoną odpowiedzialnością (2info sp. z o.o.), a company incorporated under Polish law, trading as Cardiac Purr, with its registered address at Grunwaldzka 10/1, 31-526 Kraków, Poland.
2. License Grant
Subject to your compliance with these Licensing Terms and applicable law, Cardiac Purr grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Service for personal or internal business purposes as expressly permitted herein.
This license is granted under the following conditions:
- Compliance with EU and Polish consumer protection laws
- Adherence to Digital Services Act obligations where applicable
- Respect for intellectual property rights under Directive 2004/48/EC and Polish law
- Compliance with these Licensing Terms in their entirety
This license does not transfer any ownership of intellectual property rights to you. All rights not expressly granted are reserved by Cardiac Purr.
3. Intellectual Property Rights
All content, software, algorithms, technical descriptions, and materials available through our Service are protected by:
- EU Directive 2009/24/EC on the legal protection of computer programs
- Directive 96/9/EC on the legal protection of databases
- EU Directive 2001/29/EC (InfoSoc Directive)
- Polish Act of 4 February 1994 on Copyright and Related Rights (Ustawa o prawie autorskim i prawach pokrewnych)
- International copyright treaties (Berne Convention, TRIPS Agreement)
- Applicable patent law, including pending applications filed with the USPTO
3.1 Open Source Components
Certain components of our Service may be subject to open source licenses (GPL, MIT, Apache 2.0). Source code availability complies with Article 6 of Directive 2009/24/EC. License texts are available upon written request to legal@cardiac-purr.com.
3.2 Trademark and Proprietary Designations
The names Cardiac Purr, CARDIAC-PURR, and PURR SHIELD are proprietary commercial designations of 2info sp. z o.o., protected under EU Directive 2015/2436 and Polish Industrial Property Law (Prawo własności przemysłowej) of 30 June 2000. Unauthorized use constitutes infringement under applicable intellectual property law.
4. Permitted Uses
You may:
- Access and view content for personal, non-commercial use in accordance with Article 5(1) of the InfoSoc Directive
- Make temporary copies for technical transmission purposes pursuant to the Article 5(1) transient copying exception
- Share content through sharing mechanisms expressly provided by the Service
- Use APIs in accordance with any separate API Terms we publish and the applicable provisions of the DSA
5. Prohibited Uses
Under applicable copyright law and the DSA, you may not, without our express prior written consent:
- Modify, decompile, reverse engineer, or disassemble any software or algorithm, except as expressly permitted by Article 6 of Directive 2009/24/EC (interoperability exception)
- Distribute, transmit, or publicly display content without authorization
- Use automated systems (bots, scrapers, crawlers) to access the Service without our prior written consent
- Circumvent technological protection measures in violation of Article 6 of the InfoSoc Directive
- Upload, transmit, or make available illegal content within the meaning of Article 2(1) DSA or in contravention of orders issued pursuant to Article 9 DSA
- Use the Service in a manner that infringes the rights of third parties, including intellectual property rights
- Misrepresent the origin of content or impersonate any person or entity
6. Digital Services Act Compliance
To the extent our Service qualifies as a hosting service or online platform under the DSA, we operate in accordance with:
- Transparency reporting pursuant to Article 15 DSA
- Notice and action mechanisms pursuant to Article 16 DSA
- Terms and conditions made available in a clear and accessible manner pursuant to Article 14 DSA
- Internal complaint-handling systems pursuant to Article 20 DSA
- Single point of contact for authorities and users pursuant to Articles 11–12 DSA
Cardiac Purr qualifies as a micro enterprise within the meaning of Commission Recommendation 2003/361/EC. Obligations applicable exclusively to Very Large Online Platforms (VLOPs) under Chapter III, Section 5 of the DSA do not apply.
7. Termination and Suspension
We may suspend or terminate your license with immediate effect for:
- Violation of these Licensing Terms or applicable law
- Uploading or transmitting illegal content in contravention of orders issued pursuant to Article 9 DSA
- Systematic or repeated misuse of the Service
Any restriction imposed will be proportionate to the severity of the violation. We will provide a statement of reasons for any content moderation decision in accordance with Article 17 DSA. You may challenge any such decision through our internal complaint-handling mechanism (Article 20 DSA) or via out-of-court dispute settlement (Article 21 DSA).
8. Liability and Disclaimers
Under the DSA and the Polish Civil Code (Kodeks cywilny):
- We are not liable for third-party content stored or transmitted through our Service, subject to the conditions of Articles 4–6 DSA
- Our liability for direct damages is limited to foreseeable losses arising from our breach of these terms
- The Service is provided for informational and commercial purposes; we make no warranty of uninterrupted availability
- We do not exclude liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded under mandatory Polish law or EU consumer protection provisions
9. Governing Law and Jurisdiction
These Licensing Terms are governed by Polish law. Mandatory EU consumer protection provisions applicable to users resident in other Member States remain unaffected.
Any dispute not resolved amicably shall be subject to the exclusive jurisdiction of the courts of Kraków, Poland, subject to mandatory jurisdiction rules under Regulation (EU) 1215/2012 (Brussels I Recast). Consumers may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
